Welcome to SceneLink. By accessing or using the SceneLink mobile application and related services (the “App”), you agree to be bound by these Terms of Service (“Terms”).
IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE APP.
1. Eligibility
You must be at least 18 years of age to use SceneLink. By using the App, you represent and warrant that you are legally permitted to do so and that all information you provide is accurate and truthful.
2. Description of Service
SceneLink is an event aggregation and discovery platform that:
- Displays events created by third-party admins and organizers
- Syncs events from connected Google Calendars
- Allows users to browse, vote on, and engage with events
SceneLink does not organize, host, operate, supervise, control, verify, or endorse any event. All events are solely the responsibility of the individuals or organizations that create or host them.
3. Assumption of Risk
You acknowledge and agree that attendance at any event is entirely voluntary and at your own risk. SceneLink is not responsible for the actions, omissions, safety practices, legality, or conduct of any organizer, attendee, venue, or third party.
4. User Accounts
Users may create accounts using phone authentication, Apple auth, or Google Sign-In. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account.
SceneLink is not responsible for unauthorized access resulting from your failure to safeguard your credentials.
5. Admin & Organizer Responsibilities
Group admins and organizers are solely responsible for:
- Accuracy of event details
- Compliance with applicable laws and regulations
- Venue rules, permits, and safety standards
- Consent and attendee conduct
Admins may not post or promote events that are illegal, harmful, deceptive, misleading, or non-consensual.
6. User Conduct
You agree not to:
- Harass, threaten, or abuse others
- Post illegal or non-consensual content
- Impersonate others
- Attempt to disrupt or exploit the App
- Use the App for unlawful purposes
7. Content & Moderation
SceneLink reserves the right, at its sole discretion, to remove content, restrict access, or terminate accounts without notice.
SceneLink has no obligation to monitor user content and makes no guarantees regarding accuracy, safety, or legality.
8. Third-Party Services
The App may integrate with third-party services including Google, Firebase, maps providers, and other tools. SceneLink is not responsible for the availability, accuracy, or performance of third-party services.
9. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCENELINK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SCENELINK SHALL NOT BE LIABLE FOR:
- Personal injury or death
- Property damage
- Emotional distress
- Loss of data or business
- Event-related incidents
- Third-party conduct
IN NO EVENT SHALL SCENELINK’S TOTAL LIABILITY EXCEED $0 OR THE AMOUNT YOU PAID TO USE THE APP, WHICHEVER IS GREATER.
11. Indemnification
You agree to defend, indemnify, and hold harmless SceneLink, its owners, affiliates, and operators from any claims, damages, liabilities, losses, or expenses arising from:
- Your use of the App
- Events you create, host, attend, or promote
- Your violation of these Terms
- Disputes between you and other users
12. Arbitration & Class Action Waiver
Any dispute arising from these Terms or the App shall be resolved exclusively through binding arbitration in Illinois. You waive the right to participate in any class action, collective action, or jury trial.
13. Force Majeure
SceneLink shall not be liable for delays or failures resulting from causes beyond its reasonable control, including natural disasters, governmental acts, technical failures, or service outages.
14. Governing Law
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and SceneLink regarding the App.
17. Changes to Terms
SceneLink may update these Terms at any time. Continued use of the App constitutes acceptance of the updated Terms.
